These Terms of Use ("Terms") govern your access to and use of marinmedia.video (the "Site"), operated by Marin Media ("we", "us" or "our"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Our services
The Site provides information about Marin Media and a way to contact us. Any video production, brand consulting or photography services we provide are governed by a separate written proposal, quote or agreement signed by you and us. If that agreement conflicts with these Terms, the agreement controls. Information on the Site, including service descriptions, is not an offer and may change at any time.
Use of the Site
You may use the Site only for lawful purposes. You agree not to:
- copy, scrape, frame or redistribute Site content except as permitted below;
- attempt to gain unauthorised access to the Site, its servers or any connected systems;
- introduce malware, overload the Site, or interfere with its operation;
- use the contact form to send spam, unlawful, harassing or misleading content;
- impersonate any person or misrepresent your affiliation with anyone.
Intellectual property
All content on the Site — including the Marin Media name, logo, brand marks, text, photographs, video, graphics and design — is owned by Marin Media or its licensors and is protected by U.S. and international copyright, trademark and other laws. Work produced for clients appears with their permission and may be owned by those clients.
You may view and share links to the Site for personal, non-commercial purposes. You may not reproduce, modify, distribute, publicly display or create derivative works from any content, or use our name or logo, without our prior written permission.
Your submissions
When you send us information through the Site, you confirm it is accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy. Unsolicited ideas or creative materials you send us are not confidential, and we have no obligation to use them or compensate you for them.
Copyright complaints (DMCA)
We respect the intellectual property of others. If you believe material on the Site infringes your copyright, send a notice to contact@marinmedia.video that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material you claim is infringing and where it appears on the Site; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf. We will respond promptly and remove infringing material where appropriate.
Third-party links
The Site may contain links to third-party websites or embedded media (for example video platforms). We do not control and are not responsible for their content, policies or practices, and a link does not imply endorsement.
Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MARIN MEDIA AND ITS OWNERS, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Marin Media from any claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in New Mexico, and you consent to their jurisdiction. Nothing in this section limits rights you have under the mandatory consumer-protection laws of your place of residence.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may update these Terms at any time by posting a revised version here; continued use of the Site after changes means you accept them.
